Terms and Conditions for Mobile Memory Enrichment (MME)

Welcome to Mobile Memory Enrichment (MME). These Terms and Conditions govern your use of our website, services, and programs, including caregiver coaching, the Pen Pal Program, activity kits, and other enrichment services. By accessing or using MME services, you agree to be bound by these terms.


2. Definitions

  • "MME," "we," "us," or "our" refers to Mobile Memory Enrichment, LLC.

  • "User," "you," or "your" refers to any individual who accesses or uses our services.

  • "Services" refer to all programs, products, and features offered by MME.


3. Use of Services

By using MME services, you agree to:

  • Use services only for lawful purposes and in accordance with these terms.

  • Refrain from unauthorized use, including modifying, distributing, or reselling MME content without permission.

  • Not interfere with or disrupt MME services, networks, or systems.

  • Not use MME services to distribute spam, malicious software, or fraudulent content.

  • Not engage in activities that could cause harm, distress, or inconvenience to others using our services.

We reserve the right to deny access to any user who violates these terms.


4. Registration and User Accounts

  • Some services may require you to create an account. You agree to provide accurate, complete, and current information.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • MME reserves the right to suspend or terminate accounts that violate our terms.


5. Payment and Subscription Terms

  • Fees for services, including subscription-based programs like the Pen Pal Program, are listed on our website.

  • Payments are non-refundable unless otherwise specified in a service agreement.

  • Prices may change at any time, with prior notice to active subscribers.


6. Cancellation and Refunds

One-Time Sessions & Appointments:
  • Cancellations made at least 48 hours in advance of the scheduled session are eligible for a full refund or rescheduling.

  • Cancellations made within 48 hours of the session will not be refunded but may be rescheduled once at MME’s discretion.


Subscription-Based Services (e.g., Pen Pal Program, Activity Kits, Caregiver Coaching Subscriptions):

  • Monthly subscriptions may be canceled before the next billing cycle to prevent future charges.

  • Refunds will not be issued for the current billing period once payment has been processed.

  • If a subscription includes a physical product (e.g., Activity Kits), cancellations must occur before the kit is shipped to qualify for a refund.


Exceptional Refund Cases:

  • Refunds will only be issued in exceptional cases, such as service interruptions caused by MME or an inability to fulfill a purchased service.

  • If MME determines that a participant is not a good fit for the program, a prorated refund may be issued.

  • Medical emergencies or unforeseen circumstances will be considered on a case-by-case basis.


How to Cancel:

  • Cancellations must be requested via email at mobilememoryenrichment@gmail.com or by phone at 503-662-9222.

  • Written confirmation of cancellation will be provided by MME.

  • Respite service cancellations are governed by the respite service contract and are not covered in these terms.


7. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which details how we collect, use, and protect your data.


8. Intellectual Property

  • All content on our website, including text, graphics, logos, and service materials, is owned by MME or its licensors and is protected by intellectual property laws.

  • You may not copy, reproduce, distribute, or use any MME content without obtaining written consent from MME.


9. Limitation of Liability

  • MME is not liable for any indirect, incidental, special, or consequential damages resulting from the use of our services.

  • We provide services "as is" without warranties of any kind, express or implied.

  • MME is not responsible for any third-party actions, failures, or content accessed through our services.

  • MME may provide links to third-party websites or services. We are not responsible for the privacy practices, security, or content of these third parties.

  • Users interact with third-party services at their own risk.


11. Termination

  • MME reserves the right to suspend or terminate your access to our services at any time if you violate these terms.

  • Users may discontinue use of our services at any time by canceling their account.


12. Governing Law and Dispute Resolution

  • These terms are governed by the laws of Oregon, USA.

  • Any disputes shall be resolved through arbitration and/or mediation in the state of Oregon, unless prohibited by law.

  • If arbitration or mediation does not resolve the issue, legal action may be pursued in the appropriate courts within Oregon.


13. Changes to Terms and Conditions

  • MME reserves the right to update these terms at any time. Updates will be:

    • Posted on our website with the revised effective date.

    • Sent via email to registered users when significant changes occur.

  • Continued use of MME services after updates constitutes acceptance of the new terms.
